Amendments to the PayPal User Agreement
Effective: 10 October 2024

  • We are updating the “Your use (as a seller) of personal data; Data protection laws” section of the PayPal User Agreement to remove any duplicative language and improve clarity.
  • We are clarifying that merchants are permitted to share customer personal information provided to them by PayPal with their service providers. We are also asking that merchants acknowledge they have the rights and authorities to share personal data with PayPal. This is a requirement under existing user agreement for merchant to comply with applicable data protection laws.
  • We are removing the following documents from the Legal Agreements page: (i) Key Payment and Service Information and (ii) User Agreement Reference Notes. A pdf version of the Key Payment and Service Information document and User Agreement Reference Notes is available using the links below.

Amendments to the PayPal Online Payment Services Agreement
Effective: 10 October 2024

  • We are changing this agreement to introduce a new service, the SEPA Direct Debit service, which will allow merchants to accept SEPA Direct Debits as a payment method. Consequently, we are renaming this agreement to PayPal Online Payment Services Agreement.
  • We are also changing our Merchant fee page to introduce new fees relating to this service.
  • We are introducing new terms and fees for Fraud Protection Tools, as an optional additional service.

  • We are removing the following redundant sentence in section 3: “The additional percentage-based fee for international commercial transactions set out in the User Agreement does not apply when you receive APM Payments”. This information is already covered in the PayPal Merchant Fee page. Removal of this sentence does not change how PayPal charges for APM Payments or additional percentage-based fees for international commercial transactions.

Amendments to the User Agreement
Effective 28 May 2024
:

  • Further to our policy update of 21 February 2024, we are correcting typographical errors in the Governing law and Jurisdiction clause which will read as follows:

“Governing law and Jurisdiction

This user agreement and the relationship between us is governed by the laws of England and Wales.

If you are a consumer, mandatory statutory consumer protection regulations in your country of residence shall apply irrespective of the choice of the laws of England and Wales. As a consumer, you may bring any judicial proceedings relating to this user agreement before the competent court of your place of residence, in England and Wales, or where PayPal is based.

If you are acting as a business, you agree to submit to the non-exclusive jurisdiction of the courts in England and Wales.”

Review the updated PayPal User Agreement. For the avoidance of doubt, the link to the User Agreement issued on 28 March 2024 shall be referred to instead of the versions issued on 18 March 2024 and 21 February 2024.

 

Removal of SOFORT as an alternative payment method and deletion of related terms
Effective: 28 May 2024

  • SOFORT is no longer available as an alternative payment method and is removed from the list of alternative payment method providers contained in Annex 1 of the PayPal Alternative Payment Methods Agreement.

Amendments to the PayPal User Agreement

Effective: 28 May, 2024

  • PayPal is making changes to the clauses on “Closing Your PayPal Account” (new title: “Terminating Your PayPal Account”) of the User Agreement to:
    • clarify which sections apply to consumers and which ones apply to non-consumers,
    • clarify the circumstances when PayPal may terminate accounts immediately for good cause, with prior warning and/or an opportunity to remedy the breach for consumers if reasonable,
    • remove wording on immediate termination when the PayPal account has not been accessed for 3 years,
    • provide more details on the consequences of account termination,
    • expressly refer to the Privacy Statement which clarifies for how long and for which purpose personal data is retained after termination; and
    • provide more details as to when PayPal can discontinue features and services without 2 months' notice.

These amendments are published as of the date this notice is issued, but they will formally take effect on 28 May, 2024 (“Amended Provisions”). In the meantime, for any new claims or rights of PayPal arising after the date of this notice under the section “Closing Your PayPal Account”, we will not enforce our rights under the provisions of the User Agreement dated 16 January 2024 to the extent that they are less favourable for you than the Amended Provisions. Amendments to the Privacy Statement for PayPal Services
Effective 15 April, 2024:

  • We are now offering package tracking as part of the PayPal services and we are updating our privacy statement to clarify that we may receive package tracking information from merchants when you Pay with PayPal or from your email when you provide consent.

Amendments to the PayPal User Agreement
Effective 28 May, 2024:

  • PayPal is making changes to the clauses on ‘Indemnification and Limitation of Liability’ and ‘Governing law and Jurisdiction’ in the section ’Other Legal Terms’ of the User Agreement to:
    • make clear which sections of these clauses apply to consumers and which ones apply only to businesses,
    • make clear that consumers are only responsible for losses and costs that are attributable to their own actions and that are foreseeable,
    • make clear that PayPal cannot avoid liability to consumers for any inaccurate information contained in our correspondence, reports or our website, nor which may be given verbally by our directors, officers and staff,
    • make clear that if you are a consumer, mandatory statutory consumer protection regulations in your country of residence shall apply even though the governing law of the User Agreement is England and Wales; and
    • using simpler language in some places to make sure certain terms are easier to read and understand.

PayPal has agreed to these changes with the Consumer Protection Cooperation Network. The revised version of the user agreement shall take effect on 28 May 2024.

Effective 16 January 2024:

  • Pursuant to the EU’s Digital Services Act, we are clarifying how users can complain about content others may create and actions we may take.
  • We are clarifying that PayPal may be required to place limitations on your account and/or withhold on certain gross payments received if you do not provide required tax-related information.
  • We are updating the ACDC Payments rate to 2.99% + fixed fee, under the ‘Receiving Domestic Transactions using PayPal Online Card Payment Services’ section.
  • Merchants can receive donations using Advanced Credit and Debit Card Payment.

Amendments to the PayPal Payouts Terms and Conditions

Effective 16 January 2024:

  • The PayPal Payouts Terms and Conditions are being updated to clarify existing product functionality, including:
    • Eligibility requirements for recipients of payouts to successfully receive payouts; and
    • Clarifying the respective responsibility of PayPal and senders with regard to payouts made using the PayPal Payouts product.
  • In addition, the updates provide that:
    • PayPal may require evidence of express recipient consent to receive communications in connection with payouts;
    • Customers must confirm that provision of information to PayPal does not constitute a sale of data to PayPal under applicable law; and
    • Customers may not imply PayPal sponsorship or endorsement without prior permission; nor may customers seek to obtain PayPal user credentials.

  • the Advanced Credit and Debit Card Payments suite of functionality may include the ability to integrate eligible third-party wallets as add-on features. We’re revising our terms to indicate that if you choose to integrate such add-on features, you agree to the applicable third-party terms via your acceptance of the PayPal Online Card Payment Services Agreement. Such acceptance includes your acknowledgement and agreement that such third-party features and terms are provided, updated, and noticed solely by the relevant third party and not by PayPal.

Amendments to the PayPal User Agreement

We are deleting from the section in the User Agreement headed “Actions We May Take if You Engage in Any Restricted Activities” the provision under which, if you use your PayPal account primarily for the purposes of your trade, business, craft or profession and you violate the Acceptable Use Policy, PayPal may deduct from any PayPal account you control the sum of USD 2,500 (or the prevailing equivalent in the currency of the country in which you reside) per violation of the Acceptable Use Policy (the Clause). We are also deleting references to this Clause in the corresponding heading and removing unnecessary wording relating to damages. These deletions will take effect on 17 July, 2023. In the meantime, for any new claims PayPal may have arising after the date of this notice under the Clause, we will not enforce our rights under such provisions.

Effective October 31, 2022:

  • Business accounts cannot receive personal transactions. Business account holders wishing to receive personal transactions will need to make use of a personal account.
  • If you integrate or reference PayPal services on your website, we are clarifying that PayPal may use automated technologies (e.g., website crawling) to assess your website to ensure compliance with the user agreement and to combat fraud.
  • Moving the PayPal Advertising Program terms to the User Agreement from PayPal’s Seller Protection program.
  • Introducing 18 additional currencies for withdrawals from a PayPal account and clarifying the minimum and maximum fees that may apply where withdrawal transactions are made in these currencies.

Amendments to the PayPal User Agreement

Effective August 1, 2022 we are:

  • Replacing the Pay Later payment method for consumers called “Bezahlung nach 14 Tagen” with the newer Pay Later payment method called “Bezahlung nach 30 Tagen”.
  • Amending some of the fees that apply to our services. You can preview all such changes to the PayPal Merchant Fee page by clicking the links below.
  • Amending the Reversals clause in the User Agreement to clarify when PayPal will be able to reverse a payment.
  • Clarifying the language in the governing law and jurisdiction clause. This reiterates that consumers have mandatory rights to bring cases against us in local courts.

Important notice to all EU and UK customers

As part of PayPal’s continued efforts to manage some necessary changes arising from the United Kingdom’s exit from the European Union, we will be withdrawing from the UK Financial Ombudsman Service’s (FOS) Voluntary Jurisdiction on 1st December 2022. Due to changes to UK rules, since 1st January 2021, we have been, and continue to be, subject to the Compulsory Jurisdiction of the FOS for complaints from certain UK customers (consumers and certain smaller businesses that qualify as a micro-enterprise, small business, charity, trustee or guarantor) about events occurring on or after this date and these customers continue to have the right to refer their complaint to the FOS.

Where you have a complaint that relates to an event that occurred before 1st January 2021, and you are dissatisfied with how PayPal has resolved that complaint in our final response, then you must refer that complaint to the FOS before 1st December 2022.

 

Updates to your SEPA Direct Debit Mandate

Effective: May 31, 2022

We are updating your SEPA Direct Debit Mandate by including a field known as “Type of Payment” and listing this as “Recurrent”, which is consistent with the User Agreement in which you provide us with continuous authority when linking a bank account as a funding source to your PayPal account. We will also be updating your SEPA Direct Debit Mandate by including your address.

You will continue to enjoy the benefits of using a SEPA Direct Debit mandate as usual. Please be assured this update will not affect the service you receive in any way.

 

Amendments to the Terms of use for Rechnungskauf mit Ratepay

Effective August 1, 2022 we are:

  • Clarifying that business account holders need to provide a valid EU and non-Luxembourg VAT ID.

Amendments to the PayPal User Agreement

Effective: May 6, 2022, we are:

  • Revising PayPal’s Seller Protection program to expand the list of ineligible items to include certain Non-Fungible Tokens (NFTs) with a transaction amount of more than $10,000 USD.
  • Revising the Complaints section to add additional information relating to customer complaints.
  • Incorporating the essential terms from the Key Payment and Service Information agreement into the User Agreement including details on the PayPal entity providing the PayPal services and general information on the service.
  • Adding a new section for business account holders, clarifying that liabilities owed to them by PayPal in connection with its products and services may be subject to management or write down by a regulatory or supervisory authority. We are required to include this so that public authorities do not need to bail-out financial institutions such as PayPal if they face financial difficulty.

Amendments to the PayPal User Agreement

Effective January 28, 2022 we are:

  • Relocating PayPal’s Buyer Protection program and Seller Protection program terms to separate web pages. These program terms were accepted at the time you agreed to the user agreement and remain part of the user agreement. The relocation is intended to make the terms easier to locate and navigate.
  • Revising PayPal’s Seller Protection program to clarify that proof of shipment and proof of delivery also must include an online verifiable tracking number.
  • Clarifying that abuses of our online dispute resolution process, PayPal's Buyer Protection program, and/or PayPal’s Seller Protection program are restricted activities as defined under the user agreement.
  • Clarifying that you will not be charged a Standard Dispute Fee for disputes that have met all requirements of PayPal’s Seller Protection program.
  • Clarifying that a Minimum Reserve is also known as an Upfront reserve.
  • Introducing 14 additional currencies for withdrawals from a PayPal account and clarifying the minimum and maximum fees that may apply where withdrawal transactions are made in these currencies.
  • Clarifying the definition of the European Economic Area (EEA) by introducing a list of markets/regions which form part of the EEA.

Amendments to the PayPal User Agreement

Effective: November 10, 2021

  • We are revising PayPal’s Seller Protection program to clarify eligibility for certain claims involving travel tickets sold by the travel carrier.
  • We are requiring sellers who are Corporate Customers to notify us of any pricing errors or discrepancies within sixty (60) days from having access to their account statement(s) or other account activity information.
  • We are removing the PayPal Payouts section and replacing it with a standalone agreement called the PayPal Payouts Agreement on the legal hub.
  • We are clarifying the types of costs used to calculate the reasonable minimum estimate that we may recover if you engage in any restricted activities.
  • We are introducing a new invoice solution which is reflected in the updated terms relating to invoice payments. This does not replace the existing invoice solution (referred to as “Kauf auf Rechnung”).
  • We are introducing an additional service fee of 1.29% for some international commercial transactions between the EEA and the UK.
  • We are changing the additional percentage-based fees for international commercial transactions as well as simplifying our market/region country classifications for these fees. The fees are changing from the rates shown in the current User Agreement to the new rates shown on the updated Merchant Fee page HERE, which will be effective on November 10, 2021.
  • We are also introducing a new Pay Later payment method for consumers if they decide to sign up for it called “Bezahlung nach 30 Tagen”. This will not replace the existing Pay Later product and terms for “Bezahlung nach 14 Tagen” until further notice.

Updates to the User Agreement

Effective: 18 December 2019

We’re unveiling an entirely redesigned User Agreement for our customers. We’ve worked hard to make this new User Agreement a more user-friendly experience with content that makes it easier for you to understand your rights and obligations when it comes to using PayPal’s products and services.

Here’s what we’ve done:

  1. We’ve redesigned the User Agreement to simplify its format, with new colour-coded headings so you can find the information most relevant to your account more easily. We’ve revised and reorganised the content of the User Agreement to be easier to follow and to include information where you’d naturally look for it. We’re not changing the meaning of what we say, only how we say it and where you can find it.

UPDATES TO THE PAYPAL USER AGREEMENT – EFFECTIVE DATE AUGUST 19, 2019

With effect towards August 19, 2019 we make the following changes to the PayPal User Agreement:

4.6. Refused Transaction and Refunds sent by the recipient

We have amended clause 4.6. on refused and refunded transactions, with a special focus on transactions which have been subject to a currency conversion:

We may allow the recipient of your payment to:

  • refuse to accept it; or
  • decide to accept it and then use the PayPal Services to send you a refund of all or any part of the amount of the payment later.

We will return the amount of any refused payment or refunded payment to your Balance. We will return the amount of an unclaimed payment to your Balance within 30 days after the date you initiated the payment.

If any amount of any payment is returned to you in any of the ways outlined above, we may convert the returned amount for you into either:

  • the currency of the Balance you used for the original payment (before any conversion into the currency received by the recipient happened);
  • the original opening currency of your PayPal Account.

If the original payment you sent involved a currency conversion we will convert the returned amount from the currency received by the recipient as follows:

  • if the amount is returned within 1 day of the date of the original payment, we will use the transaction exchange rate applicable on the date of the original payment, so that you receive the original amount (including the currency conversion fee you paid) in the original currency you converted from for the original payment; and
  • if the amount is returned after 1 day of the date of the original payment, we will use the transaction exchange rate applicable at the time of the conversion of the returned amount. See Section 8.2. for more information about how we set the transaction exchange rate.

We may also automatically withdraw the returned amount from your Balance and transfer the funds back to the funding source you used for the original payment. Withdrawals can also involve a currency conversion – see Section 6.

We may decide to not charge your original Funding Source for the original payment in the first place if the amount is returned to your Balance as outlined above before the payment from your original Funding Source to PayPal to fund your original payment has settled.

The returned amount could be lower in value than your original payment amount. This can happen as a result of:

  • the recipient sending you a refund lower in value than your original payment amount. As we are only a payment service provider, we cannot know what you are entitled to from the original payment recipient as a refund or why the recipient sent the refund in a particular amount; or
  • transaction exchange rate fluctuations.

PayPal is not responsible for any loss resulting from the recipient's decision to refuse or refund your payment, except to the extent that a refund sent by the recipient is a payment executed incorrectly by PayPal (see Section 12).

5.8. Your Refund Policy, Data Protection, Privacy Policy and Security

For better overview, we have divided clause 5.8. into sub-clauses. With the exception of adding the sub-clauses 5.8.1., 5.8.2., and 5.8.3. and the respective headlines, we have not applied any further changes:

UPDATES TO THE PAYPAL USER AGREEMENT – EFFECTIVE DATE OCTOBER 21, 2019

With effect towards October 21, 2019 we make the following changes to the PayPal User Agreement:

 

9.1. Restricted Activities

In clause 9.1. of we have inserted the new sub-clause 9.1.ii. for clarification:

ii. Use of the PayPal Services in connection with offerings which are illegal in the location where you are using the PayPal Services, including without limitation some online gambling offerings. If you are unsure whether or not a particular offering is illegal in your location, you must confirm the legality of the offering prior to using the PayPal Services in connection with that offering;

We have adjusted the numbering of the subsequent sub-clauses accordingly; other than that clause 9.1. remains unchanged.

 

A4.1. Currency Conversion Fee

We will increase the Currency Conversion Fee according to clause A4.1. of the PayPal User Agreement from 2.50% to 3.00% as well as some of the fees for other transactions as per the table below:

For currency conversions processed in your PayPal Account outside or prior to a Personal Transaction or a Commercial Transactions (including, but not limited to converting a Balance to another currency before withdrawal) as well as for transaction requiring a currency conversion for which the payment recipient (Seller) has agreed to bear the Fee PayPal shall charge of Fee in an amount equal to 3.00% above the base exchange rate (“Currency Conversion Fee”).

For all other transaction that require a currency conversion and for which the payment recipient (Seller) has not agreed to bear the Currency Conversion Fee, PayPal shall charge the following Currency Conversion Fee, each in percentage above the base exchange rate (to form the transaction exchange rate):

UPDATES TO THE PAYPAL USER AGREEMENT – EFFECTIVE DATE JUNE 10, 2019

All changes to the PayPal User Agreement becoming effective June 10, 2019 refer to the fees we charge for cross-border transaction and are to be found in Schedule 1: Table of Fees of the PayPal User Agreement:

A2. Fees for Personal Transactions

In Section A2. of the PayPal User Agreement, we changed the way we display fees for Domestic Personal Transactions – without making substantial changes – and we have amended and simplified the fees applicable for Cross-Border Personal Transactions. These will now apply irrespective of country corridors and we have added a minimum and maximum fees for such transactions:

A2.2. Fees for Cross-Border Personal Transactions

For transactions sent in other currencies than euro (EUR), the Fees apply in the respective transaction currency accordingly. For the required currency conversion, clause 8.2. applies.

 

A4.1. Currency Conversion Fee

In clause A4.1. of the PayPal User Agreement we have increased the Currency Conversion Fee by 0.25 percentage points, so that these fees will now apply as follows:

For currency conversions processed in your PayPal Account outside or prior to a Personal Transaction or a Commercial Transactions (including, but not limited to converting a Balance to another currency before withdrawal) as well as for transaction requiring a currency conversion for which the payment recipient (Seller) has agreed to bear the Fee PayPal shall charge of Fee in an amount equal to 2.50% above the base exchange rate (“Currency Conversion Fee”).

For all other transaction that require a currency conversion and for which the payment recipient (Seller) has not agreed to bear the Currency Conversion Fee, PayPal shall charge the following Currency Conversion Fee, each in percentage above the base exchange rate (to form the transaction exchange rate):

This page shall serve as advance information for PayPal Users with regards to important upcoming changes of the PayPal Services, the PayPal User Agreement, and other policies (collectively, the “Legal Agreements”).

Please read this document carefully. PayPal will change the Legal Agreements with effect to April 29, 2019.

You do not need to do anything to accept the changes as they will automatically come into effect on April 29, 2019.

Subsequently, PayPal will change further changes to the PayPal User Agreement with effect to June 10, 2019 as outlined further below.

Should you decide you do not wish to accept the changes, you can notify us prior to April 29, 2019 or June 10, 2019, respectively, to close your account (https://www.paypal.com/de/cgi-bin/?&cmd=_close-account) immediately without incurring any additional charges.

All changes and updates to the Legal Agreements are on this page highlighted in italic. This highlighting shall ensure better traceability of the changes and updates applied.

Amendments made for linguistic adjustment, to correct or remove orthographical and grammatical mistakes, or changes to the formatting are not highlighted. This does also apply where we have corrected or standardized numbering and references.

 

Updates to the PayPal User Agreement – Effective Date April 29, 2019

We have made the following amendments to our PayPal User Agreement:

 

5. Receiving E-Money

By way of reminder for merchants using PayPal to receive Commercial Transaction payments, on November 13, 2018 PayPal started to enable some customers without Accounts to send payments to merchants’ Accounts using alternative local payment methods.

For this purpose, on November 13, 2018, the opening paragraph of Section 5. of the PayPal User Agreement was amended to clarify how further terms of use apply to merchants when they integrate into their online checkout/platform any functionality intended to enable a customer without a PayPal Account to send a payment to the merchant’s PayPal Account (for instance, using alternative local payment methods). This includes the PayPal Local Payment Methods Agreement.

Since November 13, 2018, the opening paragraph of Section 5. has read and been applied (and will continue to read and be applied) as follows:

5. Receiving E-Money

PayPal may allow anybody (with or without a PayPal Account) to initiate a payment resulting in the issuance or transfer of E-Money to your PayPal Account. By integrating into your online checkout/platform any functionality intended to enable a payer without a PayPal Account to send a payment to your PayPal Account, you agree to all further terms of use of that functionality which PayPal will make available to you on any page on the PayPal or Braintree website (including any page for developers and our Legal Agreements page) or online platform. Such further terms include the PayPal Local Payment Methods Agreement.

 

Updates to the PayPal Buyer Protection Policy

We have made the following amendments to our PayPal Buyer Protection Policy:

Throughout the document, we have clarified references to services provided by eBay on other websites, applications or in the scope of other services than those provided on www.ebay.de and we collectively refer to such services as "eBay Services".

Hence, we have added the term and German websites, applications and other services into which eBay Services are integrated where we mention www.ebay.de: In clauses 3.1., 3.3. (twice), 5.3., 6.2.a.

In clause 5.1., we have changed the timelines from a fixed ten days to a more flexible timeline reflecting the individual case:

The Buyer must reply in a timely manner to any questions asked by PayPal in regards to the PayPal Buyer Protection Claim. PayPal may decline the Claim if the Buyer does not provide an answer within the stated timeframe. PayPal may extend this timeframe in case of extraordinary circumstances which are outside the control of the Buyer.
